Modern and Flexible Legislation

Anguilla has enacted the most modern arid flexible package of financial services legislation in the Caribbean, effective January 1995 and comprehensively amended in 2000 and subsequently expanded in 2004 by further legislation on Mutual Funds, Insurance and Protected Cell Companies.

In addition to state-of-the-art Trusts and Fraudulent Dispositions Ordinances providing for asset protection, commercial purpose and unit trusts, there is companies legislation offering a wide choice of low-cost company entities to meet the particular needs of the discerning client. In order to facilitate and induce company formations in Anguilla, the government has developed an on-line company registration system (ACORN) using the Internet. Any authorised corporate agent anywhere in the world is now able to form a company at any time of the day simply by electronically filing the articles of incorporation with the Registrar of Companies.

Altogether, The Companies Act 2000 and its complementary legislation, the International Business Companies Act 2000, The Limited Liability Act 2000 and the Limited Partnership Act 2000, as well as the other enactments (such as the Trusts Ordinance 2000, Mutual Funds Act 2004 and Insurance Act 2004), provide a comprehensive, up-to-date and effective system.
